PRIVACY POLICY

This Privacy Policy establishes the basis on which FASHION RETAIL, S.A., with registered address in Avda. de la Diputación, Edificio Inditex, 15143, Arteixo (A Coruña), Spain, a company which currently operates the online sales in Spain of its commercial brand OYSHO (hereinafter, “Fashion Retail”), as well as the companies that belong to the Inditex Group whenever applicable (hereinafter, collectively “We/Us” or the “the Data Controllers”), process your personal data when you provide it to us during your experience on the website www.oysho.com (hereinafter, “the Website”), its mobile application or app, understood to be the computer application designed to be executed on smartphones, tablets or other mobile devices (hereinafter, “the App”) or other systems, software, digital resources or devices enabled to interact with the online sales platform of products, services and functionalities related to the commercial brand OYSHO in Spain (collectively, “the Platform”).

Every time you provide us with data when you use the Platform or we need to access any type of information that allows us to identify you, such as your name, surnames, email address, billing or delivery addresses, telephone number, device type, or debit or credit card number, etc. (hereinafter, “Personal Data”), whether it is to browse on the website, purchase our products or make use of its services or functionalities, this Privacy Policy will be applicable, as well as the Cookies Policy, the Conditions of Use and Purchase, the Wallet Conditions and other documents indicated in the same (collectively, “the Terms and Conditions”) which are in effect at all times, and these texts must be revised to ensure that they are compliant with the same.

This Privacy Policy and our Terms and Conditions may be modified. It is your responsibility to read them regularly, as the Terms and Conditions in effect at the time of use of the Platform will be those which are applicable.

1. COLLECTION AND USE OF PERSONAL DATA

Remember that before using any of our services or functionalities, you should read the specific section corresponding to this service or functionality in this Privacy Policy as well as the Terms and Conditions. In each specific section, you can see if there is a particular condition regarding its use, or if it requires any specific processing of your Personal Data.

If you do not provide information that is indicated as obligatory, then it may not be possible to manage your registration as a user or to use certain functionalities or services available through the Platform.

The user (you) hereby guarantees that the Personal Data provided are true and accurate and commits to notify of any changes or modifications to the same. If you provide us with Personal Data of third parties, you are responsible for informing these third parties and having obtained their consent to provide their data for the purposes indicated in the corresponding sections of this Privacy Policy. The user will be exclusively liable for any loss or damage caused to the Platform, to the Data Controllers or to any third party due to the communication of erroneous, inaccurate or incomplete information in the registration forms.

1.1. FASHION RETAIL, as the data controller, will process your Personal Data for the following purposes:

1.1.1. Managing your registration as a user of the Platform.

The Personal Data that you provide to us will be processed to identify you as a user of the Platform and to give you access to the different functionalities, products and services available to you as a registered user.

1.1.2. The development, compliance and execution of the sales contract of the products or services that you have purchased or any other contract with Us through the Platform. In particular, the following must be taken into account:

i. If you have chosen the option to save your payment data (cards), you expressly authorise us to process the data indicated to activate and develop the Quick Shopping functionality, The card security code (CVV or CVC) is only used to make the purchase in progress, and will not be stored or further processed as part of your payment data. Consent to activate this functionality means that the payment data will be auto-completed in subsequent purchases, so it will not be necessary to enter these details again for each process, and they will be understood to be valid and in effect for future purchases. You can change or delete your cards at any time in the My Account section. We store and process your card data according to the standard international confidentiality and security principles for debit and credit cards. Use of this functionality may require changing your access code for security purposes. Remember that Platform use security also depends on you using and storing certain confidential codes correctly.

ii. If you are purchasing a Gift Card and provide us with personal data of third parties, you are responsible for having informed and having obtained their consent so that, in accordance with the Conditions of Use and Purchase of the Platform, we can process their data to (a) manage the delivery or verify the receipt of the Gift Card, and to (b) attend to any requests that you or the third party may have.

iii. If you have a Gift Receipt and you wish to return the goods associated to the same through the Platform, we will use your Personal Data provided through the return form to (a) manage your request and the process to collect the goods from your home, (b) attend to any requests related to the Gift Receipt or return that you require, and (c) confirm your acceptance of the return and delivery, by email or by other similar electronic means, of the e-voucher with the refund amount.

iv. If you use the “Wallet” service through our App, your Personal Data will be processed, in accordance with the Wallet Conditions, for the following purposes:

- Activating and storing your cards so that you can make payments through Wallet. This processing means that it will not be necessary to re-enter the Personal Data associated with your card in each process, and these will be considered to be valid and in effect for making future payments through Wallet;

- Making your payments for on-site purchases in the physical stores operated by the company OYSHO ESPAÑA S.A and enabled to this effect (hereinafter, “the Physical Stores”), when you choose the “Wallet” payment method;

- Receiving and having access to your receipts - and other associated documentation - in electronic format related to the purchases made in the Physical Stores, either because your payment has been made with Wallet or because the scanning or provision of receipts of Physical Stores that are available at all times through the App have been included in the Wallet functionalities.

1.1.3. Contacting you by email, telephone, SMS or other similar electronic means, such as App push notifications, etc. related to informational correspondence or updates related to the functionalities, products or services contracted, included Platform security updates, whenever it is necessary or reasonable for their execution.

1.1.4. Attending to the requests made to us through the online sales customer service Contact section.

1.1.5. Attending to the requests connected to your Platform user account, received through the mobile application or “InWallet” app of the Inditex Group, owned by Fashion Retail, S.A.

The connection of your Platform account to your “InWallet” app user includes your authorisation so that we can send you, through inWallet, the information related to your orders and returns of online purchases made through the Platform. The information collected in the “InWallet” app is subject to its own conditions and policies.

1.2. OYSHO ESPAÑA S.A with legal address in Avda. de la Diputación, Edificio Inditex, 15143 Arteixo (A Coruña), Spain, a company which currently operates the on-site sales in physical stores in Spain of the commercial brand OYSHO (hereinafter, “OYSHO Spain”) will process your Personal Data as data controller with the following purposes:

1.2.1. Attending to the requests made to us on the Platform through the physical stores customer service Contact section.

Furthermore, OYSHO Spain will process the data that you provide to us to manage, process and monitor the questions or requests that the customer makes, providing their Personal Data to any physical store of the commercial brand OYSHO in Spain.

1.2.2. Developing, complying and executing the sales contract of products purchased or services contracted, in accordance with the provisions of the Terms and Conditions of the Platform, in particular:

i. If you use the “Wallet” service available in the App, in accordance with the Wallet Conditions, your Personal Data will be processed to issue and facilitate access to your receipts - and other associated documentation - in electronic format related to the purchases made in the Physical Stores, either because your payment has been made with Wallet or because the scanning or provision of receipts of Physical Stores that are available at all times through the App have been included in the Wallet functionalities.

2. NEWSLETTER SUBSCRIPTION

If you authorise your subscription to the OYSHO Newsletter, Fashion Retail will provide you with information about our products and services, as well as about other brands and/or companies of the Inditex Groups (whose activities are related to the decoration, textile, finished clothing and household product sectors, as well as any sectors complementary to the aforementioned, including cosmetics and leather goods, and the development and support of e-commerce activities), including, in relation to these products and services, the sending of commercial notifications by email or by any other similar electronic means (e.g. SMS, push notifications through the App, etc.), as well as through telephone calls.

Subscription to the OYSHO Newsletter includes the use of Personal Data to provide you with customised advertising, related to our products and services through emails, SMS, App push notifications or other own or third-party collaborator electronic means. In order to improve our service, we inform you that the Personal Data related to your purchases in our online and physical stores, tastes and preferences may be used for analysis purposes, for generating use profiles, marketing studies, quality surveys and to improve interaction with our customers.

If you are a registered user, you can change your preferences regarding the sending of this commercial correspondence through My Account.

Similarly, you can cancel your Newsletter subscription though the Newsletter section on the Platform at any time, or by following the instructions that we send you in every correspondence.

3. DATA PROTECTION RIGHTS

The Data Controllers commit to respecting the confidentiality of your Personal Data and guarantee that you can exercise your rights. At all times, you can exercise your rights of access, rectification, cancellation and opposition by sending an email to: dataprotection@oysho.com indicating the reason for your request.

If necessary, we can request a copy of your national ID card, passport or other valid document that identifies you. Should you decide to exercise these rights and an email address forms part of the personal data you have provided to us, we would be grateful if you could specifically state this in your communication and indicate the email address with regard to which the rights of access, rectification, cancellation and opposition are to be exercised.

4. OTHER NECESSARY USES OF YOUR PERSONAL DATA

To comply with the purposes indicated in this Privacy Policy, it may be necessary for us to disclose or assign the information that you have provided to us to the Holding company of the Inditex Group [Industria de Diseño Textil, S.A. (Inditex, S.A.)], as well as to certain companies in the Inditex Group (whose activities are related to the decoration, textile, finished garments and home product sectors, as well as any other complementary sectors, including those of cosmetics and leather goods, and the development and support of e-commerce activities) to the extent to which they are directly involved in the provision of the Service, and as such we assume that, by registering and providing information through the Platform, you expressly authorise us to process said disclosures and/or assignments to the mentioned societies belonging to the Grupo Inditex, to the extent to which they are directly involved.

Furthermore, it may be necessary to provide your Personal Data to third parties that offer us support services, such as financial institutions, anti-fraud agencies, suppliers and providers of technological, logistics, transport and delivery services, customer service and/or analysis of transactions made on the Platform in order to offer the users sufficient guarantees in commercial operations, etc. By providing your Personal Data through this Platform, you expressly authorise us to process and share your information with the aforementioned collaborators. Your authorisation includes cases where for service efficiency, the providers may be located in the United States of America or other countries or territories located outside the European Economic Area that do not provide a data protection level comparable to that of your country or, if applicable, of the European Union.

6. USING A SOCIAL NETWORK LOGIN (FACEBOOK) AS A USER.

If you decide to log in or access your user account via a social network like Facebook, (whether as a new OYSHO user or by linking your Facebook login with your existing OYSHO account), your login details, as well as your email address, should you authorise it, will be imported from the social network account. By using this login option, the social network will be able to give us certain additional information from your public profile, such as, for example: your name, gender, approximate age or your profile picture, in accordance with the social network's terms of use. Once you've logged in via Facebook for the first time, OYSHO will not keep the additional information.

If you decide to use a social network, like Facebook, (for example, by logging in via the social network or using the social network plugins available on our platform), it could entail providing certain information about your activity on said social network.
